Park rules
The owner of a residential park may make rules about the use, enjoyment, control and management of the park.
The park owner must make all reasonable attempts to display on the notice board either:
- the current park rules
- information about how you can get a copy of the current park rules for no charge to you.
The park owner must follow a specific process if they wish to change the park rules.:
- They must set a date (objection closing day) for home owners to object to the proposed park rules.
- At least 28 days before the objection closing day, give each home owner notice of the proposal that states the closing date for objections and how they can object. Home owners can object in writing and should explain why they believe the proposal is unreasonable.
- If 5 or more home owners object (the objectors), or the park has fewer than 10 residential sites and the majority of them object before the objection closing day, the park owner and the objectors must set up a park liaison committee to consider the objections. The park liaison committee must be made up of:
- a person chosen by the objectors (which may be an objector)
- the park owner or their nominee
- someone else agreed to on by the above representatives.
The park liaison committee must consider all objections and decide whether the proposal is reasonable or unreasonable.
If the park liaison committee proposes a decision that conflicts with a home owner’s objection about a change in park rules, the committee must invite objectors to a committee meeting and tell them about the proposed decision.
The park liaison committee must give each home owner and the park owner notice of its decisions.
If there is still a dispute about the proposed change to a park rule, they or the home owner may apply to QCAT to refer the dispute for mediation.
- If there are no objections, or the number is not enough to require a park liaison committee, the proposal takes effect either:
- at the end of the objection closing day
- on a later day stated in the proposal.
